Today’s Hero: Judge Roger T. Benitez

A Cuban-born Federal Judge in San Diego  – appointed by President George W. Bush  – just issued an injunction halting enforcement of California’s unconstitutional Proposition 63.  This is a major setback for Commies Jerry Brown and Michael Bloomberg.

Prop 63 makes it illegal to own any magazine holding more than 10 rounds.  If caught – you could be jailed for a year.  Thank God Judge Benitez has read – and understood – our Constitution!

Thinking citizens – who understand our History and our Constitution understand what Prop 63 was really all about – the government’s incremental disarmament of the population.

And what better place to start that über-liberal California – where Hollywood actors (who use guns in their movies) can be counted on to support any hair-brained scheme….?

Proposition 63 – like most gun laws, – is simply “feel good” legislation designed to make people think that “government is finally doing something” – – in this case to limit the carnage of future mass shootings….

California’s new communist attorney general (former Congressman) Xavier Becerra literally came to court to argue that a mass shooter “would have to change magazines more often – giving victims a chance to escape”.

Sadly,  there are millions of simple-minded people who truly believe that passing laws changes human behavior,  – even the behavior of criminals and the insane.  Thus law-abiding citizens are subjected to the tyranny of these simpletons.

Thankfully Judge Benitez understands both human nature and History.  Maybe being born in Cuba in 1950 – and watching what Castro did there made him a believer on our Constitution.

He wrote“Any previously law-abiding person in California who still possesses a firearm magazine capable of holding more than 10 rounds will begin their new life of crime.”

If this injunction does not issue, hundreds of thousands, if not millions, of otherwise law-abiding citizens will have an untenable choice: become an outlaw or dispossess one’s self of lawfully acquired property,”

Becerra – pushed on by Governor Brown and Michael Bloomberg,  – will likely appeal to the infamous 9th Circuit – and it will likely go all the way to the Supreme Court.

We have to wonder exactly how California voters envisioned Prop 63 being enforced – since there are so many Sanctuary Cities out there…   Did they intend to form citizen search parties (lynch mobs) and search through suspected gun-owner’s homes?

Would Prop 63 give rise to a new form of Cartel smuggling – would the Sinaloa Cartel switch from smuggling cocaine to smuggling 20 and 30-round magazines across the border…?   

Gee, – maybe THEN liberals would want the WALL?

Clearly most Californians – the ones who voted for Prop 63 – don’t understand the Law of Unintended Consequences.

And,…just maybe,…might Judge Benitez have a few 15-round magazines at home?

    Prop 63 is patently unconstitutional.

    Even Justices Breyer and Sotomayor would be appalled by the overreach of this initiative.

    Political grandstanding, pure and simple, by two (2) Political Class Pajama Boys who don’t understand guns, much less gun owners, and have never fired a round, much less worn the uniform of their country.
